Orange County does not have one general business license that covers every address. Your first stop is usually the city where the business is located. County offices become more important when the address is in an unincorporated area or when the business needs a county permit, such as a food health permit or a fictitious business name filing.

A mailing address can be misleading

LLC, DBA, seller’s permit, and business license are different

Rules for unincorporated Orange County

For an address outside a city, start with Orange County Development Services. OC Planning handles land use in unincorporated areas.

Zoning, use, building, and occupancy

Ask whether the activity is allowed. A change in use or occupancy can trigger review even in an existing building. Home-business rules may limit storage, visits, signs, noise, employees, deliveries, or vehicles.

Applications and records for many unincorporated planning and property permits are available through MyOC eServices. Do not assume that a business license application includes zoning approval.

Orange County Sheriff business licenses

Orange County does not require a general county license for every unincorporated business. The Sheriff’s Department licenses certain categories. The official Business Licensing Unit page links to applications, fees, and FAQs.

The Sheriff’s licensed-business list includes peddlers, solicitors, secondhand and junk dealers, massage businesses, pool rooms, public dances, taxicab stands, and other regulated activities.

Do not apply just because your business sounds similar

Describe exactly what you sell, where you work, and whether you handle used goods, vehicles, massage, or street sales. Ask the unit to identify the correct license before paying.

Fictitious business name filing

If you use a name other than the owner’s or entity’s legal name, check the Clerk-Recorder’s fictitious business name page. The current basic fee is $23 for one name and one registrant. Each added business name is $7.

Publish a new statement once a week for four weeks in an approved newspaper. Publication must start within 45 calendar days or a new filing is needed. An FBN normally expires after five years. Use the county’s refile instructions before expiration or after a required change.

An FBN is not permission to use the address, serve food, collect sales tax, or practice a regulated profession. It also does not prove that the name is free of trademark or entity-name conflicts.

Food facilities and cottage food

Orange County Environmental Health regulates many food operations inside and outside cities. Its food health-permit page covers restaurants, markets, bakeries, wholesale operations, food trucks, carts, temporary booths, and other facilities.

A home kitchen business must use the Orange County cottage food program. Call 714-433-6000 before buying equipment, printing labels, or taking orders.

Short-term rentals in unincorporated areas

Orange County’s transient occupancy tax page applies to lodging in unincorporated areas. The current tax is 10% of rent for stays of 30 days or less. Operators must register, obtain a certificate, collect the tax, and file returns. Payment is due within one calendar month after the end of the reporting period.

Inside a city, use that city’s rental and lodging-tax rules. Platform tax collection does not prove that permits, zoning, and filings are complete.

Fire review

Cooking systems, hazardous materials, alarms, occupant load, or remodeling can trigger fire review. The Orange County Fire Authority handles this work in areas it serves. Confirm the correct fire agency locally.

Certificate of occupancy is not a business license

A certificate of occupancy or use approval confirms that the building and proposed use meet local rules. A business license registers or taxes the business activity. A commercial tenant may need both, plus building, sign, fire, or health approvals.

Entity filing is not a business license

Seller’s permit and resale certificate

A resale certificate is a document given to a supplier for qualifying resale purchases. It is not the state account or a local license.

Employees

California employers generally must register with the Employment Development Department within 15 days after paying more than $100 in wages in a calendar quarter. Use the official EDD employer payroll-tax registration page for the current rule and online process.

Professional and trade licenses

Many professions and trades need a state license. Search the Department of Consumer Affairs database and ask whether proof is needed with the local application.

Federal EIN and federal licenses

Get an EIN directly from the IRS at no charge through the official EIN page. It does not replace local or state accounts.
