California county business license guide

Last updated: October 3, 2026 | Next review: January 1, 2027

Starting a business in Alameda County can involve more than one government office. The first question is whether the business address is inside Oakland, Berkeley, Fremont, another incorporated city, or unincorporated Alameda County. That answer controls the basic local business-license, business-tax, zoning, building, and many permit steps.

Separate county and state layers may still apply, including an FBN filing, health permit, seller’s permit, entity filing, employer account, professional license, or EIN.

Bottom line

If your business is inside an incorporated city such as Oakland, Berkeley, Fremont, Alameda, Hayward, Livermore, Pleasanton, San Leandro, Dublin, Newark, Union City, Emeryville, Albany, or Piedmont, start with that city. Do not apply for an Alameda County business license simply because the address is somewhere in Alameda County.

If your business is based in or conducts business in unincorporated Alameda County, the county business license tax may apply. County Planning, Building, and other municipal-type services also focus on unincorporated areas. Use the exact street address, not just the mailing city, to identify the correct jurisdiction.

Some county functions can still matter inside cities. The Alameda County Clerk-Recorder handles FBN filings when Alameda County is the registrant’s principal place of business. Alameda County Environmental Health handles retail food facilities through most of the county, but not the City of Berkeley, which has its own Environmental Health Division.

California registrations are separate. A local license does not replace a seller’s permit, Secretary of State filing, EDD employer registration, contractor or professional license, Alcoholic Beverage Control license, or federal EIN.

Alameda County business changes: May 1–October 2, 2026

The local jurisdiction map remains materially the same in the current sources reviewed. Three state filing-system changes affect businesses that use those systems:

  • Early May 2026: California EDD added login verification, or multi-factor authentication, to Employer Services Online, including e-Services for Business.
  • July 8, 2026: CDTFA launched Quick File and the Return Filing Tool for eligible retailers filing sales tax returns online. These are filing tools; they do not replace registration for a seller’s permit or other required account.
  • August 1, 2026: California Secretary of State bizfile Online began requiring web User Access for Statement of Information filings. If the filing option is not visible, the user may need to request access to the entity record first.

These are process changes, not new Alameda County local-license requirements.

Start here: check whether the address is in a city or unincorporated Alameda County

Do this before paying a license fee, signing a lease, or starting a build-out. A postal address can use a city name even when the property is outside that city’s legal boundary.

  1. Write down the exact physical address. Use the storefront, office, home, warehouse, rental property, commissary, or other operating location. A P.O. box does not establish the licensing jurisdiction.
  2. Confirm the jurisdiction. Use Alameda County’s Community Locator and, for unincorporated property, the Planning Department’s zoning and Public Access Map resources.
  3. If the address is inside a city, start with that city. Check its business tax or license office and its planning, building, fire, and activity-specific permit pages.
  4. If it is unincorporated, start with Alameda County. The county business license, planning, zoning, and building routes are designed for unincorporated territory.
  5. Add countywide or state layers as needed. FBN, food, seller’s permit, employer, entity, professional, and federal tax steps are separate from the basic local filing.

Before a lease: Alameda County Planning specifically tells unincorporated-area businesses to check zoning before entering a financial obligation or lease. A license-tax payment does not prove that your use is allowed at the address.

Does Alameda County issue a county business license?

Yes, but its scope is important. Alameda County describes the Business License as an annual tax for doing business within the unincorporated area of the county. The county says a business located outside the unincorporated area may still need the county license if it conducts business there. A separate license is required for each branch location.

Paying the county tax does not prove that zoning, health, fire, building, or another approval has been satisfied.

Current county application path

Use the Alameda County Business License portal to reach the current apply, renew, pay-balance, and close-business actions. The current online application states that the actual business or residential address is required and directs businesses inside city limits to the city instead. It lists a $20 non-refundable application fee that is credited toward the first-year business license tax.

The county’s application also has a rental-property distinction: fewer than three residential rental units do not require this county business license; three or more residential units use the county’s residential rental form. Commercial or industrial rental property requires a business license regardless of the number of units. These statements concern the Alameda County license for unincorporated territory and do not replace a city’s rental, tax, or registration rules.

Fairview is a special fire-jurisdiction exception. Alameda County Fire says County Fire Code Administration covers unincorporated Alameda County except Fairview. Its current guidance sends Fairview fire-prevention questions to Hayward Fire. Do not assume the same fire office serves every unincorporated address.

Oakland, Berkeley, Fremont, and other city rules

Inside an incorporated city, use that city’s local process. County FBN or health involvement does not make it a county-license address.

Oakland

Oakland requires businesses doing business in the city, and rental property owners covered by its rules, to file and pay an annual business tax. For an Oakland-based business, the city says a Zoning Clearance Permit is a prerequisite to the Business Tax Certificate. The zoning-clearance rule applies to home-based businesses too, with stated exceptions such as rental-only activity and qualifying family daycares.

Use Oakland’s current Apply or Renew for a Business License or Certificate page. Oakland says renewals are due annually on or before March 1. For more detail, see our Oakland business license guide.

Berkeley

Berkeley says businesses operating directly or indirectly in the city generally need a current business license for each location. The license is a revenue tax, not zoning, building, fire, health, or other regulatory approval. A new business, new owner, or additional location uses the city’s New Business Licenses process.

Berkeley’s zoning guidance says new businesses should begin with zoning review. Berkeley also states that family daycare homes do not need a city business license under state law. Food businesses in Berkeley use the city’s own Environmental Health process rather than Alameda County’s retail food program.

Fremont

Fremont says businesses located inside or outside the city must register for a Business Tax account when conducting business in Fremont. This includes home-based businesses, commercial businesses, out-of-town businesses, contractors, and nonprofits, although an exemption may affect the tax owed.

A business registered at a Fremont residential address also needs a Home Occupation Permit through the city’s Citizen Access permitting system. For a city-specific overview, see our Fremont business license guide.

Other Alameda County cities

For other incorporated Alameda County places, check that city’s finance or business-license office plus planning, building, fire, and activity-specific departments. If you work across city lines, do not assume one local registration covers every location.

DBA and fictitious business name layer

California uses the term fictitious business name, or FBN. Many people call it a DBA. It is a name filing, not permission to operate.

Alameda County says the statement is filed with the county clerk of the registrant’s principal place of business when the FBN rules apply. Its current county page says a person or entity regularly doing business for profit under a fictitious name must file no later than 40 days after commencing business. The Clerk-Recorder also says complete business and registrant addresses are required and P.O. boxes are not accepted as those addresses.

Start with the county’s Fictitious Business Names page and the Clerk-Recorder’s FBN filing instructions. The current filing fee is $40 for one business name and one owner, plus $7 for each additional owner or FBN on the same statement.

You can enter filing information online, but the Clerk-Recorder says that online submission does not complete the filing. The registrant must appear at an office within 30 days to finish that route. After filing, an original/new FBN generally must be published as required by California law; the county FAQ says the newspaper sends proof of publication to the Clerk-Recorder.

Do not confuse the layers: an FBN does not form an LLC, approve zoning, create a seller’s permit, grant a professional license, or replace a city or unincorporated-county business license.

California state registrations and taxes

State filings sit on top of the local city-or-county map. Use the filing that matches the business activity and structure rather than treating “business license” as one universal document.

If you hire, do not stop at obtaining an EDD account. EDD says subject employers register through e-Services for Business, and California employers must report new or rehired employees to the New Employee Registry within 20 calendar days of the start-of-work date.

Coming January 1, 2027: California’s new digital-products sales and use tax rules are scheduled to take effect. CDTFA says retail sales of digital products will generally become taxable, subject to the law’s definitions, exceptions, and special rules. Businesses selling software, digital media, or other digital products should review CDTFA’s digital-products tax guide before the January 1 effective date.

Zoning, home occupation, building, fire, health, food, and industry permits

The business license or tax account is only one layer. The address and activity can trigger separate approvals.

Zoning and home occupation

For unincorporated Alameda County, use the county’s Land Use and Zoning Permits and Planning resources. The county’s New Business Guide specifically warns businesses, including home-based and cottage-food operations, to check zoning before entering a lease or other financial obligation.

Inside a city, use that city’s zoning rules. Oakland requires Zoning Clearance for businesses operating in the city, including most home-based businesses. Berkeley uses zoning approval for new business locations and home occupations. Fremont requires a Home Occupation Permit for a business registered at a residential location.

Building, occupancy, and fire

Construction, tenant improvements, electrical, plumbing, mechanical work, signs, commercial-kitchen build-outs, or a change in use can require building or related review. For unincorporated property, use the county Building Permit portal. Inside a city, use the city building department.

Fire jurisdiction can be different again. Alameda County Fire Code Administration serves unincorporated Alameda County except Fairview and also provides fire-code services by contract to Dublin, Emeryville, Newark, San Leandro, and Union City. Use its Fire Prevention address route rather than assuming the county fire department covers the whole county.

Food, restaurants, mobile food, temporary events, and home food

Alameda County Environmental Health permits and inspects retail food facilities throughout Alameda County except Berkeley, including restaurants, markets, bakeries, bars, farmers markets, catering trucks, carts, and other food facilities.

For a food truck, trailer, or compact mobile food operation, use the current Mobile Food Facilities Program. The county says mobile food facilities and compact mobile food operations generally require an Environmental Health permit, while some compact operations may qualify for a legal exemption. Temporary-event food booths use the separate Temporary Food Facility route; a standard restaurant permit does not cover a temporary event.

For a home food business, check whether the activity fits a Cottage Food Operation or a Microenterprise Home Kitchen Operation. These are separate regulatory paths with different food and operating rules.

Berkeley food businesses, food trucks, and temporary booths use the City of Berkeley Environmental Health Division. Start with Berkeley’s Food Safety and Inspection Program.

Vending, alcohol, contractors, and other regulated work

Unincorporated Alameda County adopted a sidewalk-vending ordinance in November 2025 and now lists Sidewalk Vendor Resources on its business-resources page. Food vendors may have both the vending path and Environmental Health requirements.

Alcohol sales require the state ABC license path and may also trigger local zoning. Contractors should check CSLB plus local rules where they are based or work. For hazardous materials, use Alameda County Environmental Health’s Hazardous Materials Division; its jurisdiction is activity- and location-specific. Cannabis, tobacco, massage, child care, transportation, and entertainment can have separate routes too.

Common mistakes to avoid

  • Applying to Alameda County for a city address. The county business-license route is for unincorporated activity.
  • Using the mailing city as proof of jurisdiction. Confirm the legal city boundary for the exact address.
  • Paying a business tax before checking zoning. A tax certificate does not make a prohibited use legal.
  • Calling an FBN a business license. It is a name filing and does not approve the business.
  • Assuming food jurisdiction follows the business-license office. Alameda County Environmental Health handles most of the county, while Berkeley has its own food program.
  • Assuming Alameda County Fire covers every unincorporated address. Fairview is excluded from County Fire Code Administration.
  • Assuming a state professional license replaces local registration. Contractors and other regulated professionals may still have city or unincorporated-county steps.
  • Forgetting separate employer actions. Registering an EDD payroll account and reporting new hires are separate duties.
  • Assuming every child-care business follows the normal city-license rule. For example, Berkeley states that family daycare homes do not need a city business license under state law.

What to ask when you contact an agency

Have the exact address, business activity, ownership type, expected start date, and whether the business is home-based, mobile, online, storefront, food-related, rental-related, or contractor-related.

Jurisdiction script

Hello, I am starting a [business type] at [exact address]. Is this address inside an incorporated city or unincorporated Alameda County? Which office handles the basic local business license or business tax for this address, and which zoning or land-use approval should I complete before I apply?

Permit script

My business will [describe activity]. Customers will [visit / not visit], and I will [sell food / sell goods / perform construction / work from home / operate mobile]. Besides the business tax or license, which building, fire, health, vending, sign, home-occupation, or activity-specific approvals apply to this address?

When an agency gives you a direct application page or written answer, save it with your records. Rules can differ by address and activity even within the same county.

FAQ

Does Alameda County have a county business license?

Yes, but the Alameda County business license tax applies to business activity in unincorporated Alameda County. If the business is inside a city, start with that city for the local license or business-tax layer.

If my business is in Oakland, do I apply through Alameda County or Oakland?

Start with Oakland for the local Business Tax Certificate and zoning layer. Alameda County or state filings may still apply separately, such as an FBN filing, food permit when county health has jurisdiction, or California tax and entity registrations.

If my business is in Berkeley, does Alameda County handle my food permit?

No for the normal Berkeley retail food path. Alameda County’s food program states that it serves Alameda County excluding the City of Berkeley. Berkeley’s Environmental Health Division permits and inspects food establishments, mobile food vendors, and temporary food booths in Berkeley.

Does a fictitious business name replace a business license?

No. An FBN or DBA is a name filing. It does not replace a city business tax certificate, the Alameda County business license tax for unincorporated activity, a seller’s permit, zoning approval, health permit, entity filing, or professional license.

Do online businesses in Alameda County need a local license?

They may. The local step depends on the physical business address and the rules of the city or unincorporated county. A home-based online seller may also need zoning or home-occupation approval and a CDTFA account depending on what it sells.

Do home-based businesses need zoning approval?

Often. Unincorporated Alameda County tells home-based businesses to check Planning and Zoning. Oakland requires Zoning Clearance for most home-based businesses, and Fremont requires a Home Occupation Permit for a business registered at a residential location. City rules vary.

Do contractors need both a CSLB license and a local business license?

They can. The CSLB license is the state contractor-licensing layer. A contractor may still need a city business-tax registration or Alameda County business license when conducting business in unincorporated territory, plus project-specific permits.

Is a California seller’s permit the same as an Alameda County business license?

No. A seller’s permit is a California tax-registration layer administered by CDTFA. The Alameda County business license is a local tax/license layer for unincorporated business activity. One does not replace the other.
