An address that says “Orlando” may be inside Orlando city limits, another municipality, or unincorporated Orange County. Check the jurisdiction before you file or pay.

Bottom line

Most businesses in Orange County must check the Orange County Business Tax Receipt, or BTR. A business inside Orlando or another listed municipality normally gets the city BTR first, then the county BTR. A business in unincorporated Orange County normally starts with county zoning approval through Fast Track.

A BTR is proof that a local business tax was paid. It is not an LLC, fictitious name registration, sales tax account, zoning permit, Certificate of Use, food permit, contractor license, or professional license. First decision: city limits or unincorporated Orange County?

The postal city is not enough. Many “Orlando” addresses are outside city limits. The actual municipality controls which local office goes first.

Municipalities that require a local BTR first

The Orange County Tax Collector currently lists Apopka, Belle Isle, Eatonville, Edgewood, Maitland, Oakland, Ocoee, Orlando, Windermere, Winter Garden, and Winter Park. A business in one of these places must obtain the municipal BTR before applying for the Orange County BTR. Bay Lake and Lake Buena Vista

The current Tax Collector instructions say these cities do not issue municipal BTRs. Businesses apply directly to the county, and the page says city or county zoning approval is not required for this BTR path. Confirm before filing.

Unincorporated Orange County

If the parcel record shows “Unincorporated,” begin with Orange County zoning. The county will review whether the proposed use is allowed at the address before the Tax Collector completes the BTR.

Do not sign a lease based only on a landlord’s promise

Ask the zoning or planning office to confirm the exact use. A space that was approved for an office may not be ready for a restaurant, salon, daycare, repair shop, public assembly use, or food production.

Orange County Business Tax Receipt process

The Orange County Tax Collector business tax page says most businesses in the county must pay a business tax. The exact process changes based on the location.

For a business inside a municipality

  1. Confirm that the address is inside the city or town.
  2. Complete the city’s BTR, zoning, use, and permit steps.
  3. Gather the city BTR, Sunbiz record, state licenses, and tax identification information.
  4. Submit the Orange County BTR application through the official Tax Collector path.

The instructions list a Social Security card or federal tax ID. Use only the official portal or an approved in-person method. Never send sensitive documents to an unverified service.

For a business in unincorporated Orange County

  1. Review the county’s BTR zoning approval process.
  2. Complete the BTR Zoning Approval Form and create an account in Orange County Fast Track.
  3. Submit the zoning application under the Zoning/BZA category.
  4. Complete any related Use Permit, building permit, fire review, inspections, or Certificate of Occupancy.
  5. After county approval, apply to the Tax Collector for the BTR and pay the assigned fee.

An existing commercial space with no alterations or occupancy change may need a Use Permit tied to the BTR case. New construction normally needs a building permit and Certificate of Occupancy. Altered spaces need the proper alteration permit.

City of Orlando Business Tax Receipt process

If the business is inside Orlando city limits, start with the city. The official Orlando BTR application page says the receipt is required before a business opens. After the city step, obtain the Orange County BTR.

Orlando application steps

  1. Check that the property is in Orlando and that the proposed use is allowed.
  2. Gather the Sunbiz record, EIN or SSN, and any state license or certification.
  3. Complete the city’s online application.
  4. Wait for the city review. Orlando says it normally sends a billing summary within 10 business days after processing.
  5. Pay the BTR and Certificate of Use charges that apply.
  6. After the city issues the local receipt, complete the Orange County BTR.

Certificate of Use

Orlando generally requires a Certificate of Use with the BTR. It confirms the activity is allowed at the location. Listed exceptions include residential, mobile, temporary, and government uses, plus certain state-regulated professionals. Check the current Certificate of Use rules instead of assuming you are exempt.

Orlando yearly declaration

Orlando sends an annual business tax declaration in April. Most businesses other than professionals must return it by June 1. The city says a missed declaration can add a 25% penalty to the next year’s BTR fees. The declaration is separate from the renewal payment.

Florida state and federal steps

Sunbiz entity and fictitious name filings

Florida’s Division of Corporations handles LLCs, corporations, and fictitious names. A fictitious name is Florida’s term for a DBA. The state’s fictitious name instructions say the name must be advertised at least once in a newspaper in the county where the principal place of business is located before filing, unless an exception applies.

The current state fee schedule lists a $50 fictitious name filing fee. Registrations are generally valid for five years and expire December 31 of the final year. Confirm the amount on the official Sunbiz fee page before paying. A fictitious name does not create an LLC or give exclusive rights to the name.

Florida Department of Revenue

If you sell taxable goods or services, the Department of Revenue says you must register before you begin taxable business activity. Use the official Florida tax account registration page. A registered sales tax dealer receives a Florida Annual Resale Certificate for Sales Tax. That certificate is not a BTR.

Professional and industry licenses

Use the state’s Open MyFlorida Business portal to find agencies by business type. Regulated work may require state approval before a local BTR is issued.

Federal tax ID and federal permits

Extra rules by business model

Home-based business

Online seller

Restaurant, bakery, or food seller

Florida splits food oversight among agencies. DBPR licenses many restaurants, caterers, mobile food vehicles, and lodging businesses. Start with the DBPR food service licensing page. Check zoning, fire safety, parking, signs, accessibility, utilities, and occupancy before paying for improvements. Orange County’s Division of Building Safety handles county building permits and inspections in unincorporated areas. A city property may use the city’s building department instead.

Public-facing or higher-risk use

Short-term rental

The city says a whole-property rental is treated differently and may require proper zoning and a BTR. Orange County’s six-cent tourist development tax is administered by the Comptroller.   • Using “Orlando” in the mailing address as proof of city jurisdiction. Check the parcel and city-limit tools.
  • Getting only the city BTR. Orlando and listed municipalities normally require the county BTR too.
  • Applying to the county before the city. For listed municipalities, the municipal BTR comes first.
  • Filing an LLC and assuming the business is licensed. Entity formation does not approve the address or activity.
  • Signing a lease before zoning review. A change in use can trigger permits, impact fees, fire work, or a Certificate of Occupancy.
  • Choosing the wrong food agency. DBPR, FDACS, and DOH regulate different food operations.
