City business license guide

Last updated: October 22, 2026

Starting a business in Fulshear means checking the city layer, Fort Bend County functions, and Texas requirements separately. Fulshear does not publish one universal city business license for every business. A physical business location may instead move through the city’s New Business Permit and Certificate of Occupancy process, while food, alarms, signs, contractors, mobile vendors, and other activities can have their own paths.

Bottom line

Do not start by searching for one “Fulshear business license.” First confirm that the address is actually inside Fulshear city limits. Then identify the approval tied to your activity and location.

For a new commercial location, Fulshear’s current New Business Permit checklist calls for a Certificate of Occupancy application, a $60 inspection fee, a floor plan, and Fort Bend County Fire Marshal approval. A restaurant or other establishment serving food also needs City of Fulshear Health Department approval. A property being converted from residential use to commercial use may need a Special Use Permit and must meet commercial-code requirements.

Texas itself does not require a general statewide business license, but state tax, entity, employer, professional, and industry registrations may still apply. A DBA or LLC filing is not a substitute for Fulshear zoning, occupancy, health, fire, or activity-specific approval.

Important 2026 changes for Fulshear businesses

  • Mobile food health licensing moved to the state on July 1, 2026. Texas DSHS now licenses mobile food vendors statewide. Fulshear’s current mobile-food page says the state health permit replaces the local mobile-food health permit and inspection path. Local fire, location, and zoning rules can still apply.
  • Texas business filings moved to SOSPortal on September 29, 2026. The Texas Secretary of State says SOSPortal replaced SOSDirect and SOSUpload for business filings, orders, and searches. Older instructions that send a new entity to SOSDirect should not be treated as the current online route.

Quick start: do these checks in this order

  1. Check the address. A Fulshear mailing address can be outside the city. Use the official Check My Address tool.
  2. Define the activity. Note whether you are a storefront, office, restaurant, home business, mobile vendor, contractor, online seller, or another regulated activity.
  3. Check zoning before signing a lease. Confirm that the exact use is allowed at the exact address.
  4. For a commercial site, check occupancy. Fulshear routes permit applications through GovWell.
  5. Add activity-specific approvals. Food, alarms, signs, mobile vending, construction, and licensed professions may have separate rules.
  6. Then handle county and state filings. Check the correct DBA route, entity filing, sales tax, and employer accounts as applicable.

First question: is your address actually inside Fulshear?

This matters more than the city name printed on your mail. Fulshear’s own address-check page warns that a mailing address may say Fulshear even when the property is outside city limits. That can change which zoning, occupancy, permitting, health, and code-enforcement rules apply.

Use the city’s official address checker or GIS resources before you rely on a city permit page. If the property is outside the incorporated city, identify the actual jurisdiction before applying or paying a fee.

Lease warning: A landlord, broker, prior tenant, or postal address cannot confirm that your intended use is allowed. Get the city’s zoning/use answer for the exact address before you make an expensive commitment.

Does Fulshear require a city business license?

Fulshear does not publish one general business license or business tax certificate for every business. Instead, the city regulates the premises and particular activities.

For a new physical commercial business, the city uses a New Business Permit checklist. It calls for:

  • Certificate of Occupancy application;
  • $60 inspection fee;
  • floor plan;
  • Fort Bend County Fire Marshal approval; and
  • City of Fulshear Health Department approval for establishments serving food.

A property converted from residential to commercial use may need a Special Use Permit and must meet commercial codes. The city’s Applications/Forms page says reference forms are posted online, but applications are submitted through GovWell.

Zoning, occupancy, building, signs, and fire

Zoning and allowed use

An LLC, tax account, or DBA does not make an address legal for your activity. Fulshear’s development code controls permitted and conditional uses. Before committing to a site, ask Planning: “Is my exact business activity allowed at this address, and what land-use or occupancy approval must be completed before I open?”

Certificate of Occupancy and building work

A Certificate of Occupancy is separate from entity or name filings. If you are remodeling, changing occupancy, or doing regulated building, electrical, gas, mechanical, or plumbing work, use the city’s Planning Services permit path before work begins.

Signs

Fulshear’s development code generally requires a sign permit before a person places, erects, relocates, replaces, or alters a sign, subject to exemptions. Check approval before ordering a permanent sign.

Fire review comes through Fort Bend County

Fort Bend County says its Fire Marshal normally serves unincorporated areas but specifically lists Fulshear among incorporated jurisdictions where it enforces fire code. Fulshear’s New Business Permit checklist also requires County Fire Marshal approval.

Start with the Fort Bend County Fire Marshal and its construction-permit information. This is a fire-code role, not a county general business license.

Running a business from home in Fulshear

Home businesses require a two-layer check: Fulshear has local home-occupation standards, while Texas law protects certain low-impact home businesses.

Fulshear’s development code includes limits involving on-site transactions, signs, visible storage, noise, deliveries, workers, and parking. For example, it generally bars buying and selling transactions at the residence but excludes transactions made entirely online from that restriction.

Texas Local Government Code § 229.902, effective June 12, 2025, limits municipal authority over a qualifying no-impact home-based business. The definition focuses on residential occupancy, no on-street parking or substantial traffic increase, activity not visible from the street, and no substantial noise increase. If the business qualifies, a municipality may not prohibit it or require a license, permit, or other approval merely to operate it, and may not force rezoning to nonresidential use.

The protection is not a blanket exemption. Applicable fire, building, health, sanitation, traffic, waste, pollution, and noise rules may still apply, as can private HOA/deed restrictions and state professional or industry licensing.

Do not automatically follow an older home-occupation permit instruction. If your activity appears to meet the Texas no-impact definition, ask Fulshear how § 229.902 applies to your facts before paying for an operating permit or seeking rezoning. Visible activity, customer traffic, outside workers, significant deliveries, or noise may change the analysis.

For background, see BLG’s verified Home Occupation Permit guide.

Food, mobile food, alarms, contractors, and other regulated businesses

A Certificate of Occupancy does not replace approvals tied to a regulated activity.

Restaurants and fixed food establishments

Fulshear now handles health services for establishments inside the city. Its Environmental Health page says businesses no longer need Fort Bend County Health for city food inspections or plan review. A new establishment, ownership change, remodel, or other covered change uses the city’s Food Establishment Permit process through GovWell. Occupancy and Fire Marshal review remain separate layers.

Mobile food vendors: major July 2026 change

Beginning July 1, 2026, Fulshear’s mobile-food page says health permitting and inspections transitioned to the Texas Department of State Health Services. DSHS now issues the statewide mobile food vendor health license.

That state license does not erase local fire, location, or zoning rules. Check Fulshear site rules and Fort Bend fire requirements in addition to the DSHS mobile food vendor license. BLG also has a verified Food Truck Business License and Permit Guide.

Temporary food events

Fulshear’s temporary-event health page lists a $25 three-day temporary retail food establishment permit and says applications should be submitted through GovWell at least three business days before the event. This is different from the statewide mobile-food vehicle license.

Commercial alarm systems

The city’s Alarm Permits page says covered alarms need a permit through GovWell before operation. The current commercial fee is $100 per alarm system, and the permit is valid for one year.

Contractors and permit work

Fulshear says contractors working within city limits must register and provide required credentials. Use the city’s contractor-registration reference and GovWell path, and separately confirm any Texas trade license required for your work.

What Fort Bend County still handles

Fulshear is in Fort Bend County, but “in the county” does not mean every county permit applies inside the city. Two county functions are especially important for a typical Fulshear business.

1. Fire Marshal review

Fort Bend County’s Fire Marshal specifically lists Fulshear as an incorporated city where it enforces fire code, and Fulshear’s city checklist directs new businesses to County Fire Marshal approval. This is a real county layer inside city limits.

2. Certain DBA/assumed-name filings

The Fort Bend County Clerk handles assumed-name certificates for certain unincorporated persons doing business in the county. The Clerk also warns that corporations, limited partnerships, limited liability partnerships, limited liability companies, and foreign filing entities file their assumed-name certificates with the Texas Secretary of State rather than the County Clerk.

A DBA is only a name filing. It does not give zoning approval, a Certificate of Occupancy, a food permit, or permission to operate a regulated business.

For the broader county jurisdiction map, use BLG’s verified Fort Bend County, TX Business License Guide.

Texas business registration, DBA, and sales tax

Texas has no general statewide business license

The Texas Governor’s Business Permit Office states that Texas does not require a general state business license. That does not eliminate Fulshear permits or state licenses tied to a profession or industry.

For a broader state map, see BLG’s verified Texas business license guide.

Entity formation: use the new SOSPortal

If you are forming a Texas LLC, corporation, or another filing entity, use the Texas Secretary of State’s current Business Services route. On September 29, 2026, the Secretary of State launched SOSPortal to replace SOSDirect and SOSUpload for business filings and searches.

Forming an LLC does not grant city land-use or operating permission. Think of entity formation and city permitting as separate tasks.

Sales and use tax

The Texas Comptroller says a sales tax permit is generally required when a person is engaged in business in Texas and sells, leases, or rents taxable goods, provides taxable services, or has certain use-tax obligations. Use the Comptroller’s Texas Online Tax Registration Application for the current state tax route.

If you are still sorting out the difference among an LLC, DBA, local permit, and sales tax permit, see BLG’s verified Business License vs LLC vs DBA vs Seller’s Permit guide.

If you hire employees

Hiring adds employer obligations that are separate from Fulshear permits. At minimum, check Texas unemployment-tax liability and registration with the Texas Workforce Commission, and complete required new-hire reporting.

TWC announced a 2026 move to its Texas Unemployment System, or TxUS, to replace older unemployment-tax registration and service applications. Use the current TWC unemployment-tax program rather than an old bookmarked UTR or UTS instruction.

The Texas Office of the Attorney General says employers must report new hires and rehires within 20 calendar days after the employee starts earning wages. Use the Texas new-hire reporting page. If your business needs an Employer Identification Number, obtain it directly from the IRS EIN page; the IRS issues EINs without a filing-service fee.

What this looks like for common Fulshear businesses

Home-based consultant

Check whether the activity fits Texas’s no-impact definition. If it does, the city cannot require an operating permit merely because the business is home-based. Private restrictions and state tax or professional rules can still apply.

Retail boutique

Confirm city limits and zoning, then follow the New Business Permit/CO path, Fire Marshal review, sign approval if needed, and Texas sales-tax registration.

Restaurant

Food truck

Use DSHS for the statewide health license, then separately check Fulshear location/zoning and applicable fire rules.

Online seller from home

Check home-business rules separately from Texas sales-tax obligations. A marketplace or online setup does not settle the local land-use question.

Contractor

Check Fulshear contractor registration before city permit work and keep any required Texas trade license current.

Common mistakes to avoid

  • Assuming a Fulshear mailing address means Fulshear city jurisdiction. Use the city address checker first.
  • Calling an LLC a business license. Entity formation does not approve your location or activity.
  • Signing a lease before zoning review. The exact use may be conditional, specific, prohibited, or require a change-of-use path.
  • Stopping after a Certificate of Occupancy. food, alarms, signs, professional work, and other activities can have additional approvals.
  • Sending a Fulshear fixed-food business to Fort Bend County Health. The city’s current health page says Fulshear now handles those city health services.
  • Using an old local mobile-food health permit after July 1, 2026. DSHS now controls the statewide mobile-food health license.
  • Ignoring the state home-business protection. A qualifying no-impact home business cannot be forced through a municipal operating permit or rezoning requirement merely because it is home-based.
  • Using SOSDirect instructions for a new Texas entity filing. SOSPortal replaced SOSDirect and SOSUpload for business filings on September 29, 2026.

  • For a home business, compare your facts with Texas’s no-impact protection and Fulshear standards.
  • For fixed food, use City of Fulshear Environmental Health.
  • For mobile food, use DSHS for health licensing and separately check local zoning/location/fire rules.
  • File a DBA in the correct place for your entity type.
  • Use SOSPortal for Texas entity filings.
  • Register for Texas sales tax when required.
  • If hiring, check TWC unemployment tax and Texas new-hire reporting.
  • Get an EIN directly from the IRS when needed.
  • Keep approvals, inspection records, and agency answers together.

What to ask Fulshear before you spend money

Planning / permits script

“I plan to operate a [business type] at [exact address]. The business will be [storefront / office / home-based / mobile / online], and customers [will / will not] visit the location. Is this address inside Fulshear city limits? Is this use allowed here? Do I need a Certificate of Occupancy, New Business Permit, Special Use Permit, building permit, sign permit, or another city approval before I open?”

Home-business script

“I operate a home-based [business type]. My activity [does / does not] create customer visits, on-street parking, visible outdoor activity, nonresident workers, noise, or significant deliveries. Does the city consider this a no-impact home-based business under Texas Local Government Code § 229.902, and what city rules still apply to my exact activity?”

Food / mobile-food script

“My business is a [restaurant / fixed food establishment / temporary-event food vendor / mobile food vendor]. Which health permit applies now, which agency issues it, and what separate Fulshear zoning, occupancy, fire, or location approvals do I need?”

Give the agency the exact address and exact activity. A vague “Do I need a business license?” question can produce an incomplete answer.
