City business license guide

Last updated: October 8, 2026

Starting a business in Fayetteville is not just one form. The first local question is usually not “Where do I get a city business license?” It is “Is this use allowed at this address, and which permits or tax accounts apply?” Fayetteville no longer charges a general municipal Business Privilege License Tax, but zoning, occupancy, signs, food, alcohol, solicitation, fire, and other activity-based rules can still apply. A new 2026 North Carolina law also limits what cities may require from qualifying no-impact home-based businesses.

Bottom line

Fayetteville does not have a general city Business Privilege License Tax for ordinary businesses. The city says it discontinued that tax effective July 1, 2015. For a storefront or other commercial site, the practical first step is still to confirm the address, zoning, and occupancy path with City of Fayetteville Development Services before you sign a lease, change a use, install a sign, or open.

County and state steps remain separate. An assumed name may require a Register of Deeds filing. Food businesses may need Cumberland County Environmental Health approval. Retailers may need a North Carolina sales and use tax account. Employers may need withholding, unemployment, new-hire reporting, and workers’ compensation checks. Home businesses now need an extra question first: does the business qualify for North Carolina’s protected “no-impact home-based business” category?

Fayetteville business changes: April 1–October 1, 2026

North Carolina changed the local home-business rules on July 7, 2026. Session Law 2026-51 created G.S. 160A-205.8. A city may not prohibit a qualifying no-impact home-based business or require a permit, license, variance, registration, or other city approval simply to operate it. The protection has limits: the business must meet the state definition, cities may enforce narrowly tailored health, safety, and residential-compatibility rules, and private deed or HOA restrictions can still apply.

This change does not erase state tax registration, professional licensing, food rules, employer duties, or other requirements that apply because of the activity itself.

Quick start: what to check first

  1. Write down your business facts. Note the business type, exact address, customer visits, workers, signs, vehicles, food or alcohol, and whether you will work from home.
  2. Confirm the address is actually in Fayetteville and check the use. The city’s E-Development Portal includes a County Map link to verify whether a project is in Fayetteville, and Development Services provides a Development Review Finder for site questions.
  3. Use the right city route. E-Development handles building, occupancy, fire, planning, zoning, sign-plan, and other development applications. Finance Collections handles beer and wine, solicitor, peddler, and seasonal-merchant items.
  4. Check county and state registrations. Use Cumberland County for assumed names, business personal property, and food permits; NCDOR for tax accounts; and the Secretary of State for entity filings.
  5. Save copies and renewal dates. Keep approvals, permits, tax account numbers, inspection records, and filing receipts in one folder.

  • County: Cumberland County.
  • General city privilege license: Fayetteville says it discontinued the Business Privilege License Tax effective July 1, 2015.
  • Main city development route: Development Services, including Planning & Zoning, Permitting & Inspections, and the E-Development Portal.
  • City activity licenses: Finance Collections handles beer and wine, solicitor, peddler, and seasonal-merchant items.
  • Home business: Since July 7, 2026, state law protects qualifying no-impact home-based businesses from city permit, license, variance, registration, or other approval requirements imposed simply to operate.
  • County DBA office: Cumberland County Register of Deeds.
  • State tax office: North Carolina Department of Revenue.

What does this mean for me?

For most Fayetteville businesses, one “business license” does not solve everything. The bigger local gate is usually the address and the activity. A shop may need zoning, occupancy, sign, state tax, and county property checks. A food truck needs county food approval plus the city zoning path for where and how it operates. A home business should first determine whether it fits the new state no-impact category; if it does not, Fayetteville’s home-occupation and zoning rules may still control.

Fayetteville city checks

General city business license or privilege license

The city’s Collections page says Fayetteville discontinued its Business Privilege License Tax effective July 1, 2015. Zoning, occupancy, fire, sign, and activity-specific approvals remain separate.

Confirm city limits and zoning before spending money

A Fayetteville mailing address does not by itself prove city jurisdiction. The current E-Development Portal links to a County Map to verify that a project is in Fayetteville. Development Services also provides a Development Review Finder.

The Planning & Zoning Division handles allowed-use questions, signs, and zoning verification. Its Unified Development Ordinance page links to the current Chapter 30 code.

Moving into an existing building

Do not assume the prior tenant’s approval works for you. Fayetteville’s existing-building guidance says to confirm the use with Zoning. A new tenant or change in use or occupancy can trigger building review.

The Permitting & Inspections Division says projects submitted after 2021 use E-Development; Fayworx is for older 2015–2021 records. E-Development includes change-of-tenant/use, occupancy, building, fire, and Planning & Zoning applications.

Home-based businesses: check the new state rule first

North Carolina’s Home-Based Business Fairness Act became law July 7, 2026. If a business meets the statutory “no-impact home-based business” definition, a city cannot require an application, registration, permit, license, variance, or other approval simply to operate it.

The category requires lawful activity, no on-street parking or substantial traffic increase, no street-visible business activity, no outside storage, and on-site employee/client numbers within the residential occupancy limit. Narrow health, safety, and residential-compatibility rules may still apply, and the law does not override deed or HOA restrictions.

If the business does not qualify, Fayetteville’s ordinary home-occupation standards can still matter. The Planning page continues to link its Incidental Home Occupation guidance. Separate food, alcohol, professional, or other activity rules can also apply. See our home occupation permit guide for background.

Signs

Planning & Zoning reviews sign permits. The current E-Development Portal lists Sign Plan Review and a separate “Foundations for Signs Only” building application. Use this current route rather than relying only on an older sign PDF.

Beer and wine, solicitors, peddlers, seasonal merchants, and fire

Collections says local beer and wine licenses run May 1 through April 30 and renew no later than May 1. Alcohol sellers should also check the NC ABC Commission.

Collections separately lists peddler and seasonal-merchant permits. Its peddler definition covers sellers traveling from place to place with inventory. Do not assume every temporary seller or food truck is automatically a peddler; the city route depends on the operating pattern and site.

Commercial premises and some activities may involve the Fire Marshal. Use the city’s Fire Inspection Information page; E-Development also includes Fire Plan Review and Fireworks Permit applications.

Cumberland County checks

Assumed business name, often called a DBA

North Carolina keeps assumed-name filing at Register of Deeds offices, but one filing can designate multiple counties. The Secretary of State says you only need to file in one county. For a Fayetteville business, the Cumberland County Register of Deeds is a local filing option.

Cumberland County lists $26 for the first page up to fifteen pages and $4 for each extra page. It also offers an online initial filing. An LLC, corporation, or limited partnership owner must already be established with the Secretary of State and include its SOS ID.

Business personal property

Cumberland County requires listing of business or income-producing personal property such as machinery, computers, furniture, signs, fixtures, and some vehicles. This annual county tax filing is separate from city zoning and state sales tax. The current personal property page explains the January listing period and extension process.

Food, lodging, mobile food, and temporary food events

Cumberland County Food and Lodging handles restaurants, food stands, mobile food units, lodging, and related permits. New or remodeled food facilities may require county plan review before construction.

Mobile food units must go through county plan review before a food-service permit is issued, and most require an approved commissary. Temporary vendors selling potentially hazardous foods must submit the application and fee at least 15 days before the event; some lower-risk foods follow a different path.

For mobile food, see our food truck license guide, then confirm both the county food permit and Fayetteville zoning/location path.

North Carolina state checks

North Carolina does not have one generic state business license for every business. Use the state licensing resources and any professional board that regulates your activity.

For an LLC, corporation, or similar entity, use the Secretary of State’s Online Business Services. Assumed names are different: the Secretary of State maintains the statewide database, but the certificate is filed with a Register of Deeds.

For taxable sales or state withholding, use NCDOR Business Registration. NCDOR says its online system covers withholding and sales and use tax and charges no fee to use the registration system.

If you hire, check the full employer path: NCSUITS for unemployment insurance, the NC New Hire Directory for new-hire reporting, and workers’ compensation. Current new-hire guidance generally requires reporting within 20 days. The Industrial Commission says businesses with three or more regular employees are generally covered, subject to exceptions.

The no-impact home-business protection limits city approval requirements; it does not cancel state tax, employer, professional, health, or industry rules.

Federal checks

Many businesses need an IRS employer identification number, or EIN. Apply directly through the IRS rather than paying a third-party site. If you form an LLC, corporation, partnership, or nonprofit, complete the state entity formation first.

Federal permits depend on the activity. For alcohol, aviation, agriculture, firearms, broadcasting, transportation, or another federally regulated field, use the SBA licenses and permits overview and then the responsible federal agency.

FinCEN changed the form of its BOI rule during this review period, but not the practical result for ordinary U.S.-created companies. On August 11, 2026, FinCEN issued a final rule confirming that U.S. companies are exempt from BOI reporting; that domestic-company exemption had already been operating under the March 2025 interim rule. Certain foreign companies registered to do business in the United States may still have BOI duties. Use the current FinCEN BOI page.

Costs you can plan for

Common mistakes to avoid

  • Calling every step a business license. Fayetteville’s general privilege license tax is discontinued, but zoning, permits, tax accounts, and county filings can still apply.
  • Assuming a Fayetteville mailing address proves city jurisdiction. Verify the site through the city portal/map before following city-only steps.
  • Signing a lease before zoning and occupancy review. Ask whether your exact use is allowed at the exact address.
  • Applying old home-occupation rules to every home business. Since July 7, 2026, qualifying no-impact home-based businesses have a state protection against city approval requirements simply to operate.
  • Routing every food truck to a peddler permit. Start with county mobile-food approval and Fayetteville zoning for the site; peddler or seasonal-merchant rules depend on the selling pattern.
  • Paying a third-party site for a free state tax registration. NCDOR says its online business registration system has no fee.
  • Ordering a sign before review. Use the current E-Development sign-plan route.
  • Forgetting county property listing. Business equipment and other income-producing personal property may need annual listing with County Tax Administration.

A compact compliance checklist

  • Confirm your exact address is inside Fayetteville before relying on city-specific rules.
  • Pick the business structure and file an entity with the North Carolina Secretary of State if your structure requires it.
  • Check whether your business name needs an assumed-name filing and which counties should be designated.
  • For a home business, test the state no-impact definition before assuming a city home-occupation approval is required.
  • For a commercial site, confirm zoning and whether occupancy, change of use, building, trade, fire, or site-plan review applies.
  • Use E-Development for the current city application path, including sign-plan review.
  • Check city beer and wine, solicitor, peddler, or seasonal-merchant rules only when the activity fits that category.
  • Use Cumberland County Environmental Health for restaurant, mobile-food-unit, and temporary-food-event rules.
  • Register with NCDOR for applicable sales and use tax or withholding accounts.
  • If hiring, check NCSUITS, the NC New Hire Directory, and workers’ compensation coverage.
  • Get an EIN directly from the IRS if your structure or federal tax duties require one.

Script for city permits or occupancy

Hello. I am moving a [business type] into [address]. Do I need a change-of-tenant/use filing, certificate of occupancy, building or trade permit, fire review, or sign-plan review before opening?

Script for Cumberland County food review

Hello. I plan to sell [food or drink] from a [restaurant / food truck / booth / event]. Which food permit, plan review, commissary, or temporary-food step applies?

If you call, record the date, office, and exact permit or filing name you were given.

What to do if this doesn’t work

If an office sends you to another office, ask for the name of the next office and the exact permit or approval to ask about. If a link is broken, start from the department home page instead of using an old PDF link. If your business does not fit a standard form, ask for a pre-application meeting or a written zoning interpretation.

FAQ

Does Fayetteville, NC require a general business license?

Fayetteville says it discontinued the municipal Business Privilege License Tax effective July 1, 2015. Zoning, occupancy, activity permits, county filings, or state tax registration may still apply.

What should I check first before opening a business in Fayetteville?

Verify that the address is inside Fayetteville, then check the exact use with Planning & Zoning. For a commercial site, confirm occupancy and permit needs before signing a lease or opening.

Do I need a DBA in Cumberland County?

You may need an assumed business name certificate if you use an assumed name. North Carolina says one county filing can designate multiple counties. Confirm the filing with the Cumberland County Register of Deeds.

Can I run a business from home in Fayetteville?

Possibly. Since July 7, 2026, qualifying no-impact home-based businesses are protected from city permit, license, variance, registration, or other approval requirements imposed simply to operate. Businesses outside that definition may still face Fayetteville zoning rules, and separate tax, health, professional, HOA, or deed rules can still apply.

Who handles food truck permits in Fayetteville?

Cumberland County Environmental Health handles mobile-food-unit plan review and food permitting. Fayetteville Planning & Zoning handles the city land-use path for the site or a food truck court. Do not assume a peddler permit applies unless the selling pattern fits that category.

Is a North Carolina sales and use tax registration the same as a city business license?

No. Sales and use tax registration is handled by NCDOR. Fayetteville zoning, occupancy, and activity permits are separate local steps.

Update note

Last updated: October 8, 2026
Next review: January 6, 2027

This review rechecked Fayetteville licensing, zoning, E-Development, occupancy, sign and fire routes; Cumberland County assumed-name, property and food rules; North Carolina tax and employer systems; and federal EIN and BOI guidance. The main practical change during the review period was North Carolina’s July 7, 2026 protection for qualifying no-impact home-based businesses. FinCEN also finalized the already-existing domestic-company BOI exemption on August 11, 2026.
