City business license guide

Last updated: October 8, 2026

Starting a business in Wichita can feel confusing because the words “business license” can mean several different things. It may mean a City of Wichita license for a regulated activity, a home occupation license, a building permit, a Kansas tax registration, a food license, an employer account, or a federal permit.

This guide separates those layers for a regular person opening or running a business in Wichita, Kansas. Start with your exact activity and address.

Bottom line

The City of Wichita says it does not require one standard business license for every business inside city limits. It licenses certain business types and activities. Start with the City of Wichita business licenses page and the Wichita startup licensing page. If you work from home, sell food, hire workers, remodel a space, put up a sign, operate a short-term rental, sell alcohol or tobacco, or perform regulated work, additional steps may apply.

Quick start: what to check first

  1. Confirm the address is actually inside Wichita city limits. Use the city’s Map Search – GIS to check city limits and zoning layers.
  2. Search your activity on the City of Wichita license categories page.
  3. If you work from a home, check the city’s Home Occupation category and current application materials.
  4. Before signing a lease or remodeling, check zoning and ask MABCD whether building, trade, inspection, or occupancy steps apply.
  5. Register with Kansas agencies when your entity, taxes, food activity, employees, alcohol, tobacco, or professional work requires it.
  6. Get an EIN directly from the IRS if your structure or federal tax situation requires one.

Wichita business changes: April 1–October 1, 2026

Two city licensing changes stood out during this review period.

  • Short-term rental applications became easier to file online. In April 2026, Wichita amended City Code section 3.40.080 to remove several notarization requirements from the short-term rental license application. The applicant now certifies the required statements through the application instead. The city’s current online Short-Term Rental application reflects that electronic process.
  • Wichita expanded online business licensing. A May city update said more licenses could now be applied for or renewed online. A city implementation presentation listed Short-Term Rental and Mobile Food Vendor for May and massage categories for June. Use the current city page to see the live application route.

The basic rule did not change: Wichita still has no single standard license for every business.

Wichita business licensing is layered

A Kansas LLC, Wichita license, Kansas tax account, and federal EIN are different things. One does not replace the others.

City of Wichita business licenses

Wichita’s current guidance says the city does not require a standard business license for all businesses inside city limits. It publishes licenses by category, including lodging and residential uses, sales and services, liquor and tobacco, security, entertainment, transportation, and special events.

A small office consultant may have no general city license, while a mobile food vendor, short-term rental host, tobacco seller, liquor business, massage business, pawnbroker, or other regulated operator may have a named city license. Search the current Business Licenses page by activity.

The city warns that submitting an application and fee does not itself mean approval.

Important: Wichita licensing is activity-based. A city license does not replace Kansas tax registration, Kansas food licensing, MABCD permits, state professional licensing, or another required government approval.

Home occupation rules in Wichita

If you run a business from a Wichita dwelling, do not skip the home-business check. The city’s current Business Licenses page describes the Home Occupation category as a personal service home occupation on residentially zoned property. The city’s linked Home Occupation application and information says Title 3.96 requires an annual $35 fee for an occupation or business conducted in a dwelling unit.

Those two official descriptions are not worded exactly the same way. Give Business Licensing your exact activity and address rather than deciding from a label alone. The application asks about work, employees, equipment, inventory, storage, floor area, signs, vehicles, and changes to the premises.

The linked city material also addresses outdoor storage, signs, floor area, commercial vehicles, and nonresident employees. Child care, food, personal services, or repair work can bring separate rules.

During this review, Kansas legislation that would have limited some local regulation of “no-impact” home-based businesses was checked separately. That bill did not become law in 2026. Do not rely on summaries of the proposal as if they override Wichita’s current home occupation process.

For general background, see our home occupation permit guide.

Zoning, building, signs, fire, and occupancy

Before you sign a lease, buy equipment, remodel, or move inventory into a building, check whether the address and use work together. Wichita’s Map Search – GIS includes city limits and zoning layers. The Planning Department also publishes current application forms, including zoning and short-term-rental administrative permit forms.

Building and trade permits are handled through the Metropolitan Area Building and Construction Department, or MABCD. Use the current MABCD Dynamic Portal for permit, inspection, plan review, lookup, and contractor-license work in its Wichita jurisdiction.

Occupancy approval can depend on the building, proposed use, remodeling, and code conditions. Do not assume the previous tenant’s approval covers your business. Ask MABCD what permit, inspection, or occupancy step applies.

Signs are another separate layer. Wichita’s Sign Code page says the Planning Department enforces the city sign code. Fire review can also be part of a building, occupancy, event, or regulated-use process. The Wichita Fire Department’s Fire Prevention resources are the current city starting point.

Lease tip: Check city limits, zoning, buildout, signs, fire, and occupancy before you commit to a location. A cheap lease can become expensive if the use is not allowed or the space needs major work before opening.

Sedgwick County requirements that may apply

Being in Sedgwick County does not mean every Wichita business needs one county business license. County involvement depends on the activity and property.

MABCD handles many building and trade functions for Wichita and unincorporated Sedgwick County. Check MABCD permits for construction, remodeling, electrical, plumbing, mechanical, and related work. Contractors should also use the current contractor licensing page.

Business personal property can be another county issue. Sedgwick County’s business personal property page explains filings for taxable business equipment, furniture, fixtures, and other property. This can matter even for some home occupations.

Keep city and county roles separate. If the property is outside Wichita city limits, the local licensing and zoning path can change. Use the city-limit map first instead of relying on the mailing address.

Kansas state registrations and licenses

Kansas state steps depend on your legal structure and activity. The Kansas Business One Stop is a useful starting map, but important filings are handled by separate agencies.

Entity filing. Corporations, LLCs, LLPs, LPs, and other covered entities register with the Kansas Secretary of State; sole proprietors do not register there as entities. Use the current Register a Business page and “File Online” routes in the Kansas Business Operating System (KBOS). Registered entities should also check the state’s Information Reports page.

DBA or trade name. The Kansas Secretary of State says its name-reservation filing does not register an assumed, fictitious, trade, or DBA name. A tax form, bank, board, or contract may still ask for the name you use. Our LLC vs DBA vs seller’s permit guide explains the terms.

Tax registration. If you sell taxable goods or services, rent taxable items, need Kansas withholding, or have another business tax duty, use KDOR Business Registration. Use the Kansas sales tax locator for the rate tied to an exact address. The Kansas Customer Service Center handles business tax accounts and returns.

Employees. Hiring creates separate steps: KDOR withholding when applicable, KDOL unemployment registration, and new-hire reporting. Kansas requires newly hired and rehired employees to be reported within 20 days.

Food. The Kansas Department of Agriculture issues food establishment and food processor licenses. Its current food license information includes restaurants, groceries, bakeries, caterers, bars, mobile food units, wholesalers, warehouses, repackers, and manufacturers. A mobile food unit can therefore have both Wichita and KDA requirements.

Alcohol and regulated work. Kansas Alcoholic Beverage Control licenses many alcohol activities and requires online applications for its licenses and permits. Start with the KDOR liquor licenses and permits page. Other professions and industries may have their own Kansas board or agency.

Federal steps that may apply

Most Wichita businesses do not get a general federal business license. Federal steps are activity-specific.

Get an EIN directly from the IRS EIN page; the IRS does not charge for it. The SBA licenses and permits page routes federally regulated activities to the proper agency.

FinCEN finalized its BOI rule on August 11, 2026. Domestic U.S. companies remain exempt; certain foreign companies registered to do business in the United States can still have duties. Use FinCEN’s current BOI page.

Costs you can plan for

Fees depend on the exact license, permit, project, and agency. There is no single “Wichita business license fee.”

What does this mean for me?

Do not buy a one-size-fits-all “Wichita business license package.” Write one sentence describing what you do, where you do it, customer visits, taxable sales, employees, regulated products, and remodeling or signs. Then follow the government layer that controls each part.

Real-world examples

Example 1: home-based bookkeeper

A bookkeeper working from a Wichita home should check the Home Occupation category and zoning for the address. If the owner forms an LLC, that is a separate Kansas Secretary of State step. Hiring employees can add KDOR withholding, KDOL unemployment, and new-hire reporting.

Example 2: mobile food vendor

A food truck should check Wichita’s Mobile Food Vendor license path, KDA food-establishment licensing and inspection requirements, Kansas tax registration, and any event or site permission that applies. One license does not replace the others.

Example 3: retail shop in a leased space

A shop may need Kansas sales tax registration, zoning verification, sign review, building or trade permits for remodeling, and occupancy approval. Tobacco, alcohol, food, secondhand goods, or another regulated product can add separate licenses.

Example 4: contractor or trade business

A contractor may need MABCD contractor licensing and job permits, Kansas tax or employer accounts, and a Home Occupation check if the office is in a Wichita residence.

Common mistakes to avoid

  • Assuming every Wichita business needs the same city license.
  • Forming an LLC and thinking the business is now licensed for its activity and location.
  • Signing a lease before checking city limits, zoning, occupancy, signs, and remodeling permits.
  • Running a home business without checking the Home Occupation category and current zoning limits.
  • Using an old PDF or old article when Wichita now offers a current online licensing route.
  • Selling food, alcohol, tobacco, or another regulated product before both local and state requirements are checked.
  • Hiring workers after only registering withholding and forgetting unemployment insurance or new-hire reporting.
  • Paying for a Kansas “DBA filing” without checking that the Secretary of State does not register general assumed, fictitious, trade, or DBA names.

A compact compliance checklist

  • Exact address checked for Wichita city limits and zoning.
  • City license categories checked for the exact activity.
  • Home Occupation category checked if the business operates from a dwelling.
  • Zoning, sign, building, fire, and occupancy questions checked before opening or remodeling.
  • MABCD permit and contractor-license steps checked when construction or trade work is involved.
  • Kansas entity filing checked if forming a registered entity.
  • Kansas tax registration checked through KDOR.
  • KDOL unemployment registration and new-hire reporting checked if hiring.
  • Kansas food, alcohol, tobacco, professional, or industry licensing checked when relevant.
  • Federal EIN and any federal industry permit checked.

What to do if this doesn’t work

If you still cannot tell what applies, route the question to the agency that controls that layer.

  1. Start with Wichita Business Licensing for a named city license or current application path.
  2. Use Planning or MABCD for city limits, zoning, signs, remodeling, permits, inspections, or occupancy.
  3. Use KDOR for taxes and alcohol, KDOL for unemployment and new hires, KDA for food, the Secretary of State for registered entities, and the proper state board for professional work.

If two agencies give different answers, ask each one which rule, ordinance, form, or office controls its part.

FAQ

Does every Wichita business need a city business license?

No. The City of Wichita says it does not require a standard business license for all businesses inside city limits. It licenses specific business types and activities, so you should check the current city license list for what you do.

What is the Wichita Home Occupation License?

It is Wichita’s license path for covered home occupations on residentially zoned property. The city’s linked application materials list a $35 annual fee and contain limits involving the dwelling, storage, signs, vehicles, employees, and other neighborhood-impact issues.

Does forming an LLC in Kansas replace a Wichita license?

No. An LLC is a Kansas entity filing. It does not replace any Wichita activity license, zoning or building approval, Kansas tax account, food or alcohol license, employer registration, or professional license that applies to the business.

Who handles building permits for a Wichita business space?

The Metropolitan Area Building and Construction Department, or MABCD, handles many building and trade permit, plan review, inspection, occupancy, and contractor-license functions for Wichita. Use the current MABCD Dynamic Portal and permit resources.

Do Wichita food businesses need a Kansas food license?

Many do. The Kansas Department of Agriculture licenses many food establishments and food processors, including restaurants, caterers, bakeries, groceries, bars, and mobile food units. A Wichita mobile food vendor can therefore have both city and state requirements.

Where should I start if I am not sure what applies?

Start with your exact address and exact business activity. Check Wichita’s city limits and license categories first. Then route zoning and building questions to Planning or MABCD and state tax, employer, food, alcohol, or professional questions to the Kansas agency that controls them.
