Birmingham, AL Business License Guide
Starting a business in Birmingham can involve more than one office. You may need a City business license, zoning approval, county or state privilege license, Alabama tax accounts, and federal tax steps. Food, alcohol, construction, mobile vending, signs, and home businesses can add more checks.

Bottom line
Birmingham requires businesses that conduct trade or provide services inside city limits to register with the City Finance Department and get the proper City business license. New license applicants use the city’s Application for Tax Certificate process, often called the ATC form, through the Tax and License Division. The city currently accepts new applications in person at City Hall.
The first step is your location and activity. Birmingham says each business location must be approved by the Department of Planning, Engineering and Permits before a City business license can be issued. Home-based businesses must also complete the city’s Home Occupation Certificate of Agreement process first.
Quick start: what to check first
- Confirm your address. Check whether the address is inside Birmingham city limits and whether it is in Jefferson County or another county.
- Ask zoning before you sign a lease. Contact Birmingham Zoning Division or use the city permitting page before you commit to a storefront, office, warehouse, kitchen, salon, studio, or home office.
- Start the City business license process. Review the City business license information and the supplemental documentation checklist. New applications are currently handled in person; existing registered businesses can use the HdL portal for renewal and tax work.

Important Birmingham business updates for 2026
- City tax payments are no longer accepted by mail. Since July 1, 2026, Birmingham accepts municipal business-license, occupational, sales, and other city tax payments only through its secure online system or in person at City Hall.
- The current city zoning book is the July 2026 edition. Check the current ordinance and ask Zoning about your exact address and activity before signing a lease or building out a space.
- An Alabama card-fee rule changes September 1, 2026. A separately stated, identifiable credit-card transaction fee will not be subject to sales or use tax; a fee bundled into one total remains taxable as part of that total.
- Federal BOI rules are now final. FinCEN’s August 2026 final rule exempts U.S.-created companies and U.S. persons from BOI reporting. Certain foreign-created entities registered to do business in the United States may still have duties.

Business licensing is layered. Keep each layer separate so you do not pay the wrong office or miss a rule that applies to your business type.

City of Birmingham business license
The City of Birmingham says it may license businesses conducting trade or providing services inside city limits. The city calls this a business license. It uses the Application for Tax Certificate, or ATC form, to register the business and issue a City taxpayer ID. The city code requires a license for each business line and each separate location.
For most new businesses, start with the City Tax and License Division. The city says new non-controlled license applications are taken during office hours at Room TL-100 in City Hall. Controlled licenses, such as alcohol, pool table, and dance licenses, are handled by appointment.
Documents Birmingham may ask for
The city’s checklist says the ATC form must be complete and signed. It also lists supporting documents by business type, legal structure, and activity. Examples include owner ID, Alabama Secretary of State records, or foreign authorization records when they apply.
Do not guess your NAICS code, gross receipts class, or business description. A wrong classification can affect city license fees, local tax filing, and renewals. Ask the Tax and License Division how your activity should be classified.
Renewal and license year
Birmingham’s business license year follows January 1 through December 31. Renewals are due January 1. The city currently lists the delinquency dates as January 15 for alcoholic beverage licenses, February 15 for general business licenses, and March 4 for insurance companies. Penalties and interest apply after the date for your license type. Check the city page each year before renewing.
Existing registered businesses can use the city’s online business tax and license system for renewal and payments. New businesses should still read the current city application instructions before assuming the online portal is enough.
Payment change: Beginning July 1, 2026, Birmingham stopped accepting municipal tax payments by mail. Pay through the secure city portal or in person on the first floor of City Hall at 710 20th Street North. This includes business-license, occupational, sales, and other city tax payments.
Zoning, home occupation rules, permits, and inspections
Birmingham ties business licensing to location approval. The city checklist says each business location must be approved by Planning, Engineering and Permits before a City business license can be issued. If you move, the new location must be approved too.
The city currently publishes a July 2026 edition of the Birmingham Zoning Ordinance. Proposed changes shown on a city webpage are not the same as an adopted rule, so confirm the rule that applies on the day you file.
Home-based businesses
If you plan to work from home in Birmingham, the city says you must complete a Home Occupation Certificate of Agreement through Planning, Engineering and Permits before the City business license can be issued.
The current business-license code is strict: only a family member who lives at the home may work there; customers, clients, and employees may not come to the location; storage is limited to necessary office supplies; and any identification sign is limited to one square foot and cannot be illuminated or animated. The code also excludes some activities, including beauty parlors, barbershops, and patient-treatment offices. Storefronts, build-outs, and certificates of occupancy
If you are opening, remodeling, changing a use, adding trade work, adding a sign, or taking over a space with a different use, check permits before you sign a lease. Birmingham’s Permitting Division handles building and trade permits. A Certificate of Occupancy or Certificate of Completion may be needed after inspections are finalized.

Food trucks, food service, and temporary food events
Food businesses can involve both the city and the county health department. For a 2026 food truck, Birmingham says to begin with a City fire inspection at Fire Station No. 6. The inspection costs $100 and requires an appointment; a Birmingham inspection is required even if another city inspected the truck. After passing, the operator takes the fire paperwork to the Jefferson County Department of Health for the health permit, then submits the City mobile food vendor application with the required fire, health, and liability-insurance documents before completing the City business-license process.
JCDH says mobile food units must complete plan review before operating and generally need an approved commissary or base of operation that they return to daily. County, state, and federal steps
County checks
Most Birmingham business addresses are handled with Jefferson County offices, but do not assume. Confirm your exact address, parcel, and service area before you file.
The Alabama Department of Revenue says state and county privilege licenses are issued by the county Probate Judge or License Commissioner where the business is located, unless another rule applies. It also says a license may be required in every county where the business is conducted. Jefferson County’s Revenue Department administers State of Alabama business privilege licenses and lets a new business submit an online application for a tax or license number. County staff review the activity and tell the applicant what may be due. Shelby County has its own State Business License page and Business Revenue page.
Jefferson County’s state and county business licenses run October 1 through September 30. The county says renew between October 1 and October 31, and each location needs a county business license. Put this on a separate calendar from Birmingham’s calendar-year license.
Alabama state registrations
If you form an Alabama LLC, corporation, limited partnership, or certain other entity, check the Alabama Secretary of State Business Services pages. If your business was formed in another state and will transact business in Alabama, check whether you need foreign registration.
Retail sellers and some service businesses may need Alabama tax accounts. Alabama sales tax applies to retail sales of tangible personal property unless a specific rule says otherwise, and local taxes may also apply. ALDOR says businesses must use My Alabama Taxes to apply online for many state tax account numbers. Once a tax account exists, ALDOR says a return is required for every filing period even when no tax is due.
Sales, rental, sellers use, lodging, utility gross receipts, and simplified sellers use tax account licenses must be renewed through My Alabama Taxes each November and December. Beginning September 1, 2026, ALDOR says a credit-card transaction fee is excluded from sales and use tax only when it is separately stated and identifiable; if it is bundled into one total, the entire total is taxable.
Corporations, limited liability entities, and disregarded entities doing business in Alabama or registered under Alabama law may have Alabama Business Privilege Tax filings. For tax years beginning after December 31, 2023, ALDOR says a taxpayer whose calculated Business Privilege Tax is $100 or less is fully exempt and does not file a BPTIN, CPT, or PPT return. A business above that threshold, or one unsure how the exemption applies, should follow the current ALDOR instructions or ask a tax professional.
Employer steps
If you hire workers, check Alabama Department of Workforce requirements. For a typical non-farm business, unemployment-tax liability can begin when you have one or more workers in 20 different weeks or pay $1,500 or more in wages in a calendar quarter. Alabama’s new-hire program is mandatory for employers; businesses with five or more employees must report electronically. Workers’ compensation coverage is generally required at five or more full-time or part-time employees, including corporate officers, but on-site construction of new single-family detached homes has a special exception to the under-five rule. Confirm your situation with the agency or insurer. For payroll inside Birmingham, also confirm whether Birmingham occupational tax withholding applies.
Federal steps
Many businesses need an EIN from the IRS. The IRS says you need one for employees, partnerships, corporations, LLCs, tax-exempt organizations, trusts, estates, retirement plans, and certain other cases. The IRS EIN application is free when filed directly with the IRS.
FinCEN finalized its BOI reporting rule in August 2026, effective August 14, 2026. U.S.-created companies are exempt from BOI reporting, and U.S. persons do not have to provide BOI. Certain entities formed under foreign law and registered to do business in the United States may still have filing duties. Check FinCEN’s current BOI page before acting on an old notice, email, or filing-service demand.
Costs you can plan for
Do not use a flat “Birmingham business license cost” from a blog. Birmingham license amounts can depend on classification, gross receipts, activity, location, and whether the business is new, renewed, regulated, temporary, or controlled. Some new gross-receipts licenses are adjusted after the first 90 days of receipts.

For a Birmingham business owner, the order is simple: check the place, get the city license and taxpayer ID, set up county and state accounts, then add special permits.
An LLC is not the same thing as a business license. A sales tax account is not the same thing as a zoning approval. A health permit is not the same as permission to park a food truck.
