Starting a business in Oakland usually means checking more than one rule. The city has its own Business Tax Certificate process. Zoning may come first, while Alameda County, California, and federal steps may also apply depending on what you do.

Oakland business changes: April 1–October 1, 2026

  • Oakland adopted its FY 2026–27 Master Fee Schedule in June 2026. Current permit pages should be used for the amount due. One clear example is mobile vending: Oakland’s current page lists updated annual and semi-annual permit amounts by vendor type and a separate group-site application and annual fee.
  • California bizfile changed its online access process on August 1, 2026. The Secretary of State now requires User Access for Statement of Information filings and for users conducting online filings through bizfile Online. Most people who conduct business in Oakland need a City of Oakland Business Tax Certificate and must pay the city business tax that applies to their classification. Oakland-based businesses generally need a Zoning Clearance Permit before applying for the certificate.

Oakland zoning clearance usually comes before the city tax certificate

Oakland says a business located in the city, including a home-based business, generally needs a Zoning Clearance Permit. The clearance checks whether the proposed business activity fits the location. A separate clearance is needed for each business location, and Oakland says a new clearance is needed after a change of location or ownership.

The city also lists important exceptions. A business operating outside Oakland and a person who only rents out property do not need this zoning clearance. Oakland also says a family daycare for 14 or fewer children in the caregiver’s home for part of the day while parents or guardians are away is exempt from the Zoning Clearance Permit.

A zoning clearance covers zoning only. Depending on the facts, you may still need a Conditional Use Permit, building permit, fire review, sign approval, county health permit, alcohol license, professional license, or another approval.

Before you spend money: Check the exact address and proposed use before signing a long lease, ordering signs, starting construction, or committing to a food or mobile-vending setup. A use that worked for the prior tenant may not automatically fit your business.

For home businesses, also consider customer visits, employees, deliveries, parking, storage, noise, equipment, and signs. Food prepared at home follows separate county food programs, so do not assume an ordinary home-office path covers a cottage food or MEHKO operation.

City of Oakland Business Tax Certificate

Oakland says anyone who conducts business or owns rental property in the city must file and pay annual business tax. A business located outside Oakland may also have Oakland business-tax duties when it conducts business in the city.

The city’s current application page says new applicants can apply online through Oakland’s business-tax portal. A nonrefundable registration fee plus special fees are due within 30 days of the business or rental start date. Oakland-based businesses should obtain zoning clearance first. Wholesale and retail sellers are also told to obtain a California seller’s permit and list it on the city application.

When to apply or renew

For a new business, use the actual start date and follow the city’s 30-day application and fee instructions. For renewals, Oakland says business taxes must be paid annually on or before March 1. Do not rely on receiving a paper or email reminder; the city says the account holder remains responsible for renewing on time.

If you stop, move, sell, or close the business, update the city rather than leaving an old account open. Business-tax accounts are tied to the business facts and are not a substitute for zoning or activity-specific permits.

Alameda County steps that may apply

Fictitious business name or DBA

If you do business for profit under a name that triggers California’s fictitious-business-name rules, file in the county where the principal place of business is located. Alameda County lists common examples such as a sole proprietorship using a name that does not contain the owner’s surname, a partnership, or a corporation using a name other than its legal name.

Use the county’s Fictitious Business Name page and filing instructions. You can begin an application online, but follow the county’s current steps to complete the filing and any required publication. A DBA is a name filing; it does not replace Oakland zoning or the Business Tax Certificate.

Food, mobile food, temporary food, and home kitchens

Alameda County Environmental Health uses different paths for different food operations. Choose the route that matches how and where you prepare and sell food.

  • Retail food facilities: restaurants, markets, bakeries, bars, and similar operations start with the county Food Safety program.
  • Mobile food: food trucks and Compact Mobile Food Operations use the Mobile Food Facilities Program. A temporary-food application is not a substitute.
  • Temporary-event food: food booths use the Temporary Food Facility path. The county says selling or giving away food or drinks at a community event requires permitting.
  • Home kitchens: Cottage Food Operations and MEHKO are separate programs. Use the county’s Home-Based Food Business page to choose the correct path. County guidance says Alameda County cottage-food applicants also need City Planning approval.

California state steps that may apply

California seller’s permit

If you are engaged in business in California and sell or lease tangible personal property that would normally be subject to sales tax at retail, you may need a seller’s permit from CDTFA. Future change — January 1, 2027: CDTFA says California sales and use tax will generally apply to retail sales of digital products. Some digital-product sellers may need CDTFA registration. This is not yet effective on October 1, 2026.

California Secretary of State

If you form or maintain an LLC, corporation, limited partnership, or another state-filed entity, use bizfile. Effective August 1, 2026, User Access is required for Statement of Information filings and for users conducting online filings through bizfile Online.

California employer registration and new-hire reporting

If you hire employees, EDD says a commercial employer generally must register for an employer payroll tax account within 15 days after paying more than $100 in wages in a calendar quarter. Use EDD’s employer registration guidance. California employers must also report new and rehired employees to the New Employee Registry within 20 calendar days of the start-of-work date.

Professional and industry licenses

Some work needs a state license even after Oakland issues its local certificate. Use CalGold to identify agencies, then verify with the responsible state board. Alcohol sellers should use ABC’s current license application guidance.

Federal steps that may apply

Many businesses use an Employer Identification Number for federal tax and banking purposes. Apply through the IRS EIN page; the IRS does not charge for an EIN.

FinCEN issued a final BOI rule on August 11, 2026. Under the current rule, U.S. companies are exempt from BOI reporting; only certain foreign companies registered to do business in the United States remain reporting companies.
